Arbitration Agreement
This Arbitration Agreement (“Agreement”) is entered into by and between My Mechanics LLC (“Company”), its users, including but not limited to mechanics and customers (collectively, the “Parties”), and governs the resolution of disputes arising out of or relating to the use of the Company’s services, platform, or any transactions facilitated by the Company.
1. Agreement to Arbitrate
By accessing, using, or registering with the services of My Mechanics LLC, the Parties agree that any dispute, claim, or controversy arising out of or related to:
• The terms and conditions of the Company’s platform;
• The relationship between mechanics and customers facilitated by the platform;
• Payments, services rendered, or any other interaction facilitated through My Mechanics LLC;
• Alleged breaches of this Agreement; will be resolved exclusively through binding arbitration as described in this Agreement, except as otherwise provided herein.
2. Waiver of Jury Trial and Class Actions
By agreeing to arbitration:
• The Parties waive their right to a trial by jury in any court proceeding arising out of this Agreement.
• The Parties agree that all claims must be brought in their individual capacities and not as plaintiffs or class members in any class, collective, or representative action.
3. Arbitration Rules and Procedures
• The arbitration shall be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration service.
• The arbitration shall be conducted in the English language.
• The arbitration shall take place in Hillsborough County, Florida, unless the Parties mutually agree to a different location or virtual arbitration.
• The arbitrator shall have the authority to determine the enforceability of this Agreement, including issues relating to its scope.
4. Costs of Arbitration
• The costs of arbitration shall be shared equally between the Parties unless otherwise determined by the arbitrator.
• Each Party shall bear its own attorneys’ fees, unless otherwise provided by law or awarded by the arbitrator.
5. Exceptions to Arbitration
The following claims are not subject to arbitration:
• Claims for injunctive or equitable relief necessary to enforce intellectual property rights;
• Claims that cannot, by applicable law, be submitted to arbitration.
6. Confidentiality
All arbitration proceedings, including but not limited to testimony, documents, and awards, shall remain confidential, except as necessary to enforce or challenge the arbitration award in a court of competent jurisdiction.
7. Severability
If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
8. Opt-Out Option
Users may opt out of this Arbitration Agreement by providing written notice to My Mechanics LLC at 1866 Jim Redman Pkwy #1029 Plant City, FL 33563 United States within 30 days of agreeing to the Terms of Service.
9. Governing Law and Jurisdiction
This Arbitration Agreement shall be governed by the laws of the State of Florida. Any arbitration or related proceedings shall be conducted in Hillsborough County, Florida.
10. Acknowledgment and Agreement
By using the services provided by My Mechanics LLC, the Parties acknowledge that they have read and understand this Arbitration Agreement and agree to be bound by its terms.
